Liability Waiver

Assumption of Risk, Release, and Waiver of Liability. Please read carefully. It affects your legal rights.

Terms of ServicePrivacy PolicyLiability Waiver

1. The risks are real

Kicking, punting, and the drills, conditioning, and practice that go with them are physical activities with inherent risks. These include, but aren't limited to, muscle strains and pulls, joint and ligament injuries, overuse injuries, falls, being struck by a ball, heat-related illness, and in rare cases serious injury. Risks also come from the field, weather, equipment, other people, and your own physical condition.

2. Instruction is remote

Jack McCallister Kicking & Punting coaches online. Your coach is not physically present, can't see your full surroundings, and can't supervise, spot, or stop you during practice. You're responsible for practicing safely: warming up, using a safe field and proper equipment, practicing within your ability, staying hydrated, and having appropriate supervision (for athletes under 18, an adult).

3. Not medical advice

Our coaching is not medical, physical therapy, or athletic training advice. Talk to a doctor before starting any new training program, especially if you have an injury or health condition. Stop immediately and get medical help if you feel pain, dizziness, or anything unusual.

4. Assumption of risk

By using our services, you knowingly and voluntarily accept all of these risks, known and unknown, for yourself.

5. Release of liability

To the fullest extent permitted by law, you release, waive, and agree not to sue Jack McCallister Kicking & Punting, Jack McCallister, and anyone acting on their behalf for any injury, illness, loss, or damage arising out of or related to the instruction, drills, feedback, or advice you receive, or your practice or training, including claims based on ordinary negligence. This release does not cover gross negligence, reckless or intentional misconduct, or anything else the law doesn't allow to be waived.

6. Athletes under 18

If the athlete is under 18, the parent or legal guardian who approves the account confirms they've read this waiver, agrees to it on the athlete's behalf and on their own behalf, and agrees to supervise the athlete's training. To the extent the law allows, the parent or guardian also agrees to cover any costs that result from a claim brought on the athlete's behalf that this waiver would otherwise release.

7. Other terms

This waiver is part of our Terms of Service and is governed by Washington law. If any part is found unenforceable, the rest still applies. It stays in effect for all of your use of our services.
