Terms of Service

1. Who we are

Jack McCallister Kicking & Punting is operated by Jack McCallister, a sole proprietor based in Washington State, USA ("we," "us," or "your coach"). Contact: mccallisterjack7@gmail.com.

2. Who can use the site

• You must be at least 13 years old to have an account.
• If you're 13 to 17, a parent or legal guardian must approve your account before you can upload film, book calls, or make purchases. By approving, they agree to these Terms and the Liability Waiver on your behalf and accept responsibility for your use of the site.
• Anyone making a payment must be 18 or older.
• You agree to give accurate information, keep your password private, and tell us if you think someone else is using your account.

3. What we provide

We offer online kicking and punting instruction, including written and timestamped review of film you upload ("Film Reviews") and live one-on-one video calls ("Calls"). Instruction is educational. We aim to complete Film Reviews promptly but don't guarantee a specific turnaround time.

4. No guaranteed results

Improvement depends on many things outside our control, including your effort, health, and practice environment. We don't guarantee any particular result, including improved performance, a roster spot, playing time, a scholarship, recruiting interest, or a professional opportunity.

5. Prices and payment

• Prices are shown on the site before you pay. We may change prices at any time, but changes won't affect anything you've already paid for.
• Payments are processed by PayPal (including Venmo and card payments). We never see or store your full card or bank details. PayPal's own terms also apply.
• There are no subscriptions and no automatic recurring charges.

6. Cancellations and refunds

• Calls: cancel at least 24 hours before the start time for a full refund. Cancellations within 24 hours, and missed calls, aren't refunded. If we cancel a call, you get a full refund.
• Film Reviews: you can cancel for a full refund until your coach starts the review. Once a review has started it can't be refunded. If we decline a review, you get a full refund.
• If something goes wrong on our end (for example, a technical problem prevents a call), contact us and we'll make it right with a reschedule or refund.
• Refunds go back to the original payment method and may take several business days to appear.

7. Film and content you upload

• You keep ownership of your videos and other content.
• You give us permission to store, view, and analyze your content only to provide coaching to you, and to keep it in your film history until you delete your account.
• We won't share your film publicly or use it in marketing unless you give separate, specific permission, which you can withdraw at any time.
• You confirm you have the right to upload your content, including film recorded by a team, school, or third party, and that it doesn't violate anyone's rights or any law.
• Don't upload anything unlawful, sexual, hateful, or unrelated to coaching. We may remove content or suspend accounts that break these rules.

8. Calls

Calls take place on third-party video services (such as Zoom, Google Meet, or FaceTime). Neither side may record a call without the other's permission. Athletes under 18 should have a parent or guardian aware of and, ideally, nearby during calls.

9. Health and safety

Kicking and punting involve physical risk. Your use of our instruction is subject to the Liability Waiver, which is part of these Terms. Nothing we provide is medical advice.

10. Third-party services

The site relies on outside services, including PayPal, Google (email delivery and, if enabled, calendar), video-call providers, and video hosts like YouTube or Hudl for linked film. We aren't responsible for those services, and their terms and privacy policies apply when you use them.

11. Ending your account

You can delete your account at any time from your Profile. We may suspend or close accounts that break these Terms or misuse the site. Sections that by their nature should continue (like payments owed, disclaimers, and limits on liability) survive after your account ends.

12. Disclaimers

The site and our services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. We don't promise the site will always be available or error-free.

13. Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, or consequential damages, or for lost opportunities, scholarships, or profits. Our total liability for any claim relating to the site or our services is limited to the amount you paid us in the 6 months before the claim arose. Nothing in these Terms limits liability that can't be limited by law, including for gross negligence or intentional misconduct.

14. Indemnity

You agree to cover any losses or legal costs we incur because of content you upload that you didn't have the right to share, or because you broke these Terms or the law.

15. Disputes and governing law

Please contact us first. Most issues can be solved quickly. These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Washington State, and you consent to their jurisdiction.

16. Changes

We may update these Terms. If we make important changes, we'll update the date at the top and, where appropriate, ask you to accept the new version. Continuing to use the site after changes means you accept them.
